By downloading, installing, or using Deflare ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Deflare is a breathing and nervous system regulation app designed to support individuals managing POTS (Postural Orthostatic Tachycardia Syndrome) and dysautonomia. The App provides guided breathing protocols, educational content, check-in tracking, and progressive training programs.
Deflare is not a medical device. The App provides educational support and guided breathing exercises only. It does not diagnose, treat, cure, or prevent any disease or medical condition.
You must be at least 13 years of age to use Deflare. If you are under 18, you must have the consent of a parent or legal guardian.
Free Features: Deflare offers core breathing protocols and features at no cost.
Premium Subscription: Additional protocols, guided audio sessions, and the Build program are available through a monthly subscription.
You agree to use the App only for its intended purpose and not to:
All content in Deflare, including but not limited to text, graphics, breathing protocols, audio scripts, animations, design elements, and software code, is owned by Flo Life LLC and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without written permission.
Your use of Deflare is also governed by our Privacy Policy, which describes how we handle your information. By using the App, you consent to the practices described in the Privacy Policy.
If you grant Deflare access to Apple HealthKit, your heart rate data is read and processed locally on your device. This data is never transmitted to external servers. You may revoke HealthKit access at any time through iOS Settings.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Flo Life LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising out of or relating to your use of the App.
Our total liability for any claim arising from or relating to these Terms or the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Flo Life LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your right to use the App ceases immediately.
We reserve the right to modify these Terms at any time. Changes will be posted within the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Salt Lake City, Utah. You waive any right to participate in a class action lawsuit or class-wide arbitration.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
